1. Purpose and scope
This Acceptable Use & Content Policy is part of the Terms of Service of VMA Social Media LLC. It applies to every client, every business we promote and every piece of content, campaign, website, store, message or automation that we create, publish or manage, including materials provided by the client. It also applies to the use of our website.
A signed Proposal cannot override this policy. If a request conflicts with it, we will explain why and, where possible, suggest a compliant alternative.
2. No fake engagement
We do not use, and clients may not ask us to use, any practice that fakes popularity or manipulates Platforms. This includes:
- buying or selling followers, likes, views, comments, shares, subscribers or saves;
- bots, fake or purchased accounts, automated follow/unfollow and mass-liking tools;
- engagement pods, follow-for-follow or like-for-like schemes;
- fake, purchased or incentivized reviews, ratings or testimonials;
- spam, including unsolicited comments, direct messages, emails, texts or WhatsApp messages;
- buying, renting or scraping email, phone or contact lists; and
- cloaking, misleading redirects or any method designed to evade a Platform’s review.
3. Businesses we do not serve
We do not provide services to, or create content for, businesses or offers in these categories:
- illegal products or services, or products that are illegal where they are promoted;
- weapons, firearms, ammunition, explosives and their parts or accessories;
- illegal or recreational drugs, drug paraphernalia, prescription drugs without a valid license, and unlicensed cannabis, hemp or CBD products, or any of these with health or medical claims;
- tobacco, vaping and nicotine products;
- adult content, sexual services, escort or dating services of a sexual nature;
- gambling, betting, casinos, lotteries and sweepstakes that require payment;
- multi-level marketing (MLM), pyramid and Ponzi schemes;
- get-rich-quick offers, guaranteed income or returns, debt relief or credit repair with guaranteed outcomes, and other offers with financial guarantees;
- cryptocurrency investment schemes, trading signals, unregistered securities, ICOs and similar offers;
- counterfeit, replica or unauthorized branded goods;
- surveillance or spyware products, hacking services, fake documents, and services to evade the law; and
- any business subject to U.S. sanctions or located in an embargoed country.
4. Prohibited content
We do not create, publish, promote or keep published content that:
- promotes hate, violence, discrimination or harassment against any person or group based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, age, disability or any other protected characteristic;
- harasses, threatens, bullies, defames or impersonates any person or business;
- contains misinformation, including false or misleading information about health, elections, public safety or current events;
- makes misleading health, medical, weight-loss or “cure” claims, or before-and-after claims that cannot be supported;
- is sexually explicit, or sexualizes minors in any way;
- infringes anyone’s copyright, trademark, right of publicity or privacy, including using a person’s image or voice without permission;
- uses a competitor’s trademarks or name in a confusing or misleading way;
- is deceptive, including fake scarcity, fake countdowns, hidden fees, bait-and-switch or misleading pricing; or
- targets children under 13 or collects their data in violation of the Children’s Online Privacy Protection Act (COPPA).
5. Regulated industries
Some lawful businesses are subject to special advertising rules, such as alcohol, healthcare and medical services, dietary supplements, cosmetics, financial services, insurance, legal services, real estate, housing, employment, credit, and political, electoral or social-issue advertising. We review these engagements case by case. If we accept them, the client must hold all required licenses, must give us the regulatory requirements that apply to its advertising, and must approve all claims. We follow each Platform’s special-category rules, such as restrictions on audience targeting for housing, employment and credit ads, and the identity verification and “paid for by” disclaimers required for political and social-issue ads.
6. Honest advertising and claims
Advertising must be truthful, not misleading, and supported by evidence, as required by the FTC Act and similar state and international laws. The client is responsible for every claim made about its own products and services, including prices, discounts, availability, results, comparisons, “made in” claims, health and safety claims and environmental claims, and must keep evidence that supports them. We may ask for that evidence before publishing a claim and may refuse to publish a claim we believe is unsupported.
Customer results, testimonials and case studies must reflect real experiences, and any results that are not typical must be clearly identified as such.
7. Influencers, UGC and endorsements
All influencer and UGC campaigns we manage follow the FTC Guides Concerning the Use of Endorsements and Testimonials in Advertising. This means:
- every creator with a material connection to the brand (payment, free products, commissions, family or employment ties) must clearly and conspicuously disclose it, for example with “#ad”, “Paid partnership” or the Platform’s branded content tool;
- creators may only say what they honestly believe and have actually experienced;
- creators may not make claims the brand itself could not legally make;
- content usage rights, duration and channels are defined in writing with each creator; and
- we do not hire creators under 18 years old without the written consent of a parent or guardian and compliance with applicable child performer laws.
8. Reviews and reputation
Our reviews and reputation services follow the FTC’s rule on the use of consumer reviews and testimonials and each Platform’s review policies. We do not write, buy or post fake reviews; offer discounts, gifts or payments in exchange for reviews (or for positive reviews); ask only happy customers for reviews when a Platform prohibits it; suppress or hide negative reviews by unlawful means; or post reviews from employees or related parties without disclosure. We respond to reviews professionally and truthfully, without disclosing customers’ private information.
9. Email, SMS and WhatsApp
- Email campaigns must comply with the CAN-SPAM Act: accurate sender information, non-deceptive subject lines, a valid physical postal address, a working unsubscribe link and opt-outs honored within ten (10) business days. We send marketing emails only to contacts who opted in or have an existing relationship with the client, as permitted by law.
- SMS and text messages must comply with the Telephone Consumer Protection Act (TCPA), carrier rules and state laws. Marketing texts require the recipient’s prior express written consent, must identify the business, must include STOP and HELP instructions and may only be sent between 8:00 a.m. and 9:00 p.m. in the recipient’s local time, or a narrower window where state law requires it.
- WhatsApp messages must follow the WhatsApp Business Messaging Policy, including opt-in consent before business-initiated messages and the use of approved message templates.
- Lists. The client must tell us accurately how each contact list was collected and when consent was given. We do not use purchased, rented, shared or scraped lists, and we may ask for proof of consent before sending.
10. Audience data and privacy
The client must have a privacy policy that discloses its use of pixels, tags, analytics, custom audiences and the other tools we install or manage, and must obtain any consent required by law (for example, cookie consent for visitors from certain jurisdictions). Customer lists uploaded to advertising Platforms must have been collected lawfully and with the notices and consents those Platforms require. We do not collect or target sensitive data (such as health conditions, sexual orientation, religion or financial hardship) in ways that violate the law or Platform policies. See our Privacy Policy.
11. Intellectual property and materials
The client must own or have permission to use every logo, photo, video, song, font, testimonial, product image and other material it gives us, including model releases for identifiable people. We use properly licensed stock assets, fonts and music and respect their license limits. We will remove content promptly if we receive a valid notice that it infringes someone’s rights.
12. AI-generated content
When we use AI tools to assist with content, a person on our team reviews it for accuracy, originality and compliance before delivery. We do not use AI to create deepfakes, to imitate a real person’s face, voice or likeness without that person’s written permission, or to create fake testimonials, fake reviews or fake people presented as real customers. Where a Platform or law requires AI-generated or altered content to be labeled, we label it.
13. Platform rules
All content and campaigns must comply with the terms, community guidelines and advertising policies of each Platform where they appear, including Meta, Instagram, TikTok, Google, YouTube, LinkedIn, X, WhatsApp, Shopify and email and SMS providers. Where a Platform’s rules are stricter than this policy, the Platform’s rules apply.
14. Enforcement
If we reasonably believe a client, request or piece of content violates this policy, we may, at our discretion:
- refuse to create, publish or run the content or campaign;
- pause or remove content or campaigns we manage;
- ask for evidence, licenses or proof of consent;
- suspend the Services; or
- terminate the engagement as described in our Terms of Service.
Fees for work already performed are not refunded when we suspend or terminate the Services because of a violation of this policy. See our Refund & Cancellation Policy. We may also report illegal activity to the relevant authorities or Platforms.
15. Reporting a concern
If you believe content we created or manage violates this policy, infringes your rights or is unlawful, please write to legal@vmasocial.us with a link to the content, a description of the issue and your contact details. We review every report and respond as described below.
